Article 1 — Definitions

« Acheteur » ou « Client » : means any natural or legal person subscribing to a Service from EDENN SCHOOL via the Site.

« CGV » : means these General Terms of Sale.

« Commande » : means any subscription to a Service by the Client via the Site.

« Convention de stage » : means the tripartite document established between the student, the training organization and the host company, legally governing the internship.

« Formation » : means any e-learning training offer available on the Site, composed of written materials (PDF), audio and/or video, tests and exercises.

« Service » : means all services offered by EDENN SCHOOL, including online training and internship agreements.

« Site » : means the website accessible at www.Edenn School.com.

« Société » ou « EDENN SCHOOL » : means MHR Education LLC, headquartered at 1209 Mountain Road PL NE, Ste R, Albuquerque, NM 87110, USA.

Article 2 — Purpose and Scope

These GTS govern the contractual relations between EDENN SCHOOL and the Client in the context of the sale of online training and internship agreements. They define the conditions applicable to any purchase made through the Site, whether the Client is an individual or a professional.

The acquisition of a Service implies acceptance without reservation by the Client of these GTS. Payment validation constitutes full and complete acceptance of these GTS, acknowledgment of having full knowledge thereof, and waiver of relying on their own purchasing conditions.

Article 3 — Service Characteristics

3.1 Nature of Services

EDENN SCHOOL is a private online training organization that offers:

E-learning Training: Access to online training modules, teaching materials (videos, PDFs, exercises), progress tracking, platform access for contract duration.

Internship Agreement: Tripartite internship agreement and administrative follow-up during internship.

3.2 Internship Agreement Prerequisites

Important: No internship agreement will be issued without prior registration for a EDENN SCHOOL online training. Access to Services is only available subject to having a valid French and/or European passport, OR a valid residence permit for the entire duration of the internship agreement.

3.3 Required Information for Internship Agreement

About the Intern: Full name, date of birth, postal address, phone number & email, last diploma or training.

About the Host Company: Legal company name, SIRET number, internship location address, tutor name, position & email.

3.4 Grounds for Refusal

EDENN SCHOOL reserves the right to refuse issuing an internship agreement in the following cases:

Planned compensation below applicable legal minimums
Internship duration exceeding six months
Incomplete or clearly inaccurate information
Any other reason making internship execution impossible under regulations

Article 4 — Order Process

To place an Order, the Client must:

  1. Select the desired training on the Site
  2. Fill in the online registration form with personal information
  3. Accept these GTS
  4. Proceed to payment of the total Order amount

The Order is validated upon receipt of full payment by EDENN SCHOOL. A confirmation email is sent to the Client containing the Order summary, applicable GTS, and platform access information.

Article 5 — Prices and Payment

Service prices are indicated in euros including all taxes (TTC) on the Site. EDENN SCHOOL reserves the right to modify its prices at any time. However, the applicable price is the one in effect at the time of Order validation.

5.1 Payment Methods

Payment is due in full at the time of Order validation. Payment is made by credit card via the secure payment system Stripe:

Accepted cards: Visa, MasterCard, American Express.

Payment data is processed exclusively by Stripe and is not accessible to EDENN SCHOOL. Stripe complies with PCI-DSS security standards.

Article 6 — Delivery and Access

Training Access: Access to the training platform is immediate upon payment validation. The Client receives their credentials by email and can start their training right away.

Internship Agreement: Delivered by email within 24 business hours after receiving all required information.

Express Option: If the Client has subscribed to the express delivery option, the internship agreement is delivered within 2 hours of receiving all required information.

Platform access is granted for one (1) year from the Order date. At the end of this period, access is automatically closed without prior notice.

Article 7 — Guarantees

"Agreement Accepted or Refunded" Guarantee: EDENN SCHOOL offers the following guarantee: if the provided internship agreement is refused by the host company, the Client can obtain a refund under the conditions below.

Conditions: The internship tutor (maître de stage) indicated in the internship agreement must send an email to contact@edenn-school.fr explaining the reasons for the refusal. The request must be submitted within 1 month of receiving the agreement.

Administrative fees: An amount of €50 corresponding to non-refundable administrative fees will be deducted from any refund. These fees cover the costs of creating and processing the file.

EDENN SCHOOL is only bound by an obligation of means. It does not guarantee acceptance of the internship agreement by the host company, obtaining employment, or any professional or academic result.

Article 8 — Liability

EDENN SCHOOL commits to providing Services with diligence and in accordance with these GTS. Its liability is limited to direct and proven damages by the Client.

EDENN SCHOOL cannot be held liable for: indirect damages (loss of opportunity, commercial prejudice, etc.), interpretations made by the Client, use made of training and agreements, or network or Client equipment malfunctions.

Liability cap: In any case, EDENN SCHOOL's liability is capped at the amount actually paid by the Client for the concerned Order.

Article 9 — Agreement Modifications

The Client can modify their internship agreement information (dates, tutor name, address, etc.) directly from their personal space on the platform.

If the Client is unable to make the modification from their personal space, they can contact the EDENN SCHOOL team by email at contact@edenn-school.fr or via the contact form on the Site.

IMPORTANT: No unauthorized modification can be made to official documents (internship agreement, student card, enrollment certificate) by anyone. In case of unauthorized modification or falsification, EDENN SCHOOL reserves the right to cancel the agreement, the Client may be prosecuted, and the host company will be informed.

Article 10 — Intellectual Property

All elements of the Site and training (texts, videos, images, exercises, methodologies, etc.) are and remain the exclusive intellectual property of EDENN SCHOOL. The Client benefits from a strictly personal, non-exclusive, non-transferable license for the duration of their access to Services.

The Client is prohibited from: reproducing, copying, distributing content; sharing access credentials; recording or downloading video content; using content for commercial purposes. Any violation constitutes infringement subject to civil and criminal prosecution.

Article 11 — Personal Data

Processing of Client personal data is carried out in accordance with the Privacy Policy accessible on the Site. For any questions about your personal data: contact@edenn-school.fr

Article 12 — Archiving and Proof

EDENN SCHOOL archives purchase orders and invoices on a reliable and durable medium, in accordance with legal provisions. The computerized records of EDENN SCHOOL shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 13 — Force Majeure

EDENN SCHOOL cannot be held liable for non-performance or delay in performance of its obligations resulting from force majeure as defined by Article 1218 of the French Civil Code and case law (natural disasters, fires, strikes, epidemics, pandemics, telecommunications interruptions, government decisions, etc.).

Article 14 — Partial Nullity

If a provision of these GTS is declared null or inapplicable, the other provisions shall retain their full force and effect.

Article 15 — Applicable Law and Disputes

These GTS are governed by the law of the State of New Mexico, United States. For consumers residing in France or the European Union, mandatory consumer protection provisions applicable in their country of residence apply.

In case of dispute, the Client will first contact EDENN SCHOOL to try to find an amicable solution. This amicable procedure constitutes a mandatory prerequisite for any legal action.
